Alina Habba has resigned as the US Attorney for New Jersey. This comes after a legal ruling that challenged her right to serve.

Official Departure

US Attorney General, Pam Bondi, announced Habba's resignation on Monday. Bondi stated that the appeals court finding made it "untenable" for the official to effectively run her office.

"Let no one confuse following the order as giving up," she wrote. "This battle will now stretch across the nation."

Court Ruling

Her resignation was triggered by a federal appellate panel ruled that she had been acting without proper authority as US attorney. This decision is expected to impact scores of prosecutions in the Garden State.

The judicial panel ruled that a acting appointment that skirted the advice and consent of the Senate ran afoul of the statute on vacant positions.

It was also stated that Habba will continue working within the DOJ as a high-level advisor. Habba plans to pursue additional appeals of the disqualification, in the hope of achieving a different outcome.

Writing online, she wrote that the court "should not be able to override the President's choice of lawyers tasked with carrying out the fundamental role of the presidency of prosecuting crime."

Habba, originally became part of Donald Trump's lawyers in recent years. She later acted for her client in his business records case in the previous year, when he was guilty verdict on dozens of charges of falsifying business records.

Prior to her appointment to the top New Jersey post, Trump had announced he was appointing her as his senior adviser if re-elected, describing the lawyer as deeply loyal and a relentless legal advocate.
