A stipulation in the latest federal appropriations bill would outlaw a broad spectrum of hemp-based cannabinoid goods starting in November 2026.

That initiative shuts the hemp “opening,” arising from the 2018 Farm Bill, and possibly reshapes a $28 billion sector.

Advocates warn that the ban may curb availability and drive many to riskier, unsupervised substitutes.

Shutting the Hemp ‘Gap’

The bill practically shuts the hemp “gap” originating from the 2018 Farm Bill. That part of legislation established a definition for hemp separate from cannabis.

This bill defined hemp as any type of cannabis variety or its extracts containing no higher than 0.3% delta-9 cannabinoid by desiccated weight.

Delta-9 THC is the most abundant, intoxicating chemical present in cannabis.

Weed and hemp are both varieties of the cannabis variety, but they are molecularly distinct. Whereas hemp includes less than 0.3% THC, marijuana has much more.

This classification described in the Farm Bill reclassified hemp as an agricultural product; meanwhile, marijuana remains an illegal Schedule 1 substance.

The Manner the Revised Bill Respecifies Hemp

The appropriations bill provision introduces drastic changes to the manner hemp is defined at the government stage.
